These guidelines establish the general policies applicable to marketing, reservations, cancellations, rescheduling, and gift card sales for marine wildlife sighting tours operated by Hydro Sport S.R.L. Whale Watching in the Valdés Peninsula area, Province of Chubut.
These guidelines are mandatory for all bookings made in person, by phone, or through the company’s official website. Their purpose is to ensure transparent operations, adequate consumer information, and compliance with current regulations, particularly Law 24,240 and the Civil and Commercial Code of the Nation.
II. RESERVATION AND CONFIRMATION POLICIES
Reservations will be considered confirmed once payment has been received and the applicable cancellation policy has been expressly noted.
Passengers must arrive at the designated time with the required documentation and comply with the safety instructions provided by company staff.
III. NATURE OF THE SERVICE—OBSERVATION CONDITIONS
The activities offered consist of boat trips designed for whale watching, dolphin watching, or observing other marine species in their natural habitat.
It is expressly stated that:
-The service constitutes an obligation of means, not of results,
-Sightings depend entirely on natural, biological, and climatic factors beyond the company's control.
-We cannot guarantee that 100% of the identified species will be visible or that wildlife will be observed during all excursions.
The operation of the cruise in accordance with safety conditions and applicable regulations constitutes fulfillment of the contracted service, even if the sighting expected by the passenger does not occur.
IV. CANCELLATIONS AND RESCHEDULING DUE TO WEATHER CONDITIONS
Departures are subject to hydrometeorological, maritime, and nautical safety conditions, which are the sole responsibility of the Maritime Authority (Argentine Coast Guard).
The Company/Port may cancel, suspend, or reschedule the activity if any of the following conditions exist:
-Adverse weather conditions.
-Operational safety reasons.
-Cases of unforeseeable circumstances or force majeure.
In such cases, the passenger will be entitled to: reschedule the departure at no additional cost, subject to availability, or receive a full refund or reschedule the service for another date through the same booking channel.
No additional compensation or reimbursement shall be payable if the cancellation is due to causes beyond the Company’s control.
V. CANCELLATION POLICIES BY THE CUSTOMER
Cancellations must be made through the same method used to make the reservation.
Failure by the passenger to arrive on time and in accordance with the requirements will result in the forfeiture of the full amount paid, in accordance with the terms and conditions provided at the time of booking.
Cancellations made less than 24 hours in advance: No refund will be issued for the ticket
VI. GIFT CARD
VALIDITY: The gift card is valid for thirty (30) calendar days from the date of issue.
Once this period has elapsed:
-The code will expire automatically.
-It cannot be used.
-It does not entitle the holder to any extension or compensation. The gift card is non-refundable; once purchased:
-No cancellations will be accepted
-No full or partial refunds will be issued
-No refunds will be issued for unused portions within the validity period, nor will any credit be issued to the customer.
VII. RIGHT OF WITHDRAWAL—DISTANCE CONTRACTS
Pursuant to Article 34 of Law 24,240 and related provisions of the CCCYN, the consumer may revoke their acceptance of a contract entered into remotely (via a website, electronic means, or telephone) within TEN (10) calendar days from the date the contract was entered into.
The cancellation must be communicated through the same means used to enter into the contract or by a reliable method, and no penalty may be imposed for exercising this right.
In the event of a valid cancellation made within the legal timeframe, the Company will issue a full refund of the amounts paid, using the same payment method that was originally used.
